By purchasing a Membership or otherwise attending classes, events, activities, and other programs and by using the premises, facilities and equipment of Volare, Member hereby acknowledges that there are certain inherent risks and dangers in indoor cycling and barre classes and in association with the classes and use of the Volare facilities. Member acknowledges that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. Member also acknowledges that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, rhabdomyolysis, and concussions; and (3) catastrophic injuries including paralysis and death.

Member has read and thoroughly understands the any safety instructions that are posted on Volare’s Website, a hard copy of which is also available in studio, upon request. Member has also ensured s/he is familiar with any and all equipment used at Volare. At all times, Member shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to Member by staff.

If in the subjective opinion of the Volare staff, Member would be at physical risk in Volare classes, Member understands and agrees that s/he may be denied access to the classes and facilities until Member furnishes Volare with an opinion letter from her/his medical doctor, at Member’s sole cost and expense, specifically addressing Volare’s concerns and stating that Volare’s concerns are unfounded.

In consideration of being allowed to participate in and access the classes and facilities at Volare, Member hereby (1) agrees to assume full responsibility for any and all injuries or damage which are sustained or aggravated by Member in relation to the classes and facilities, whether sustained while using exercise equipment or not, (2) agrees to release, indemnify, and hold harmless Volare, its affiliates, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the classes or use of the facilities, and (3) represents that Member (a) has no medical or physical condition that would prevent Member from properly participating in any of Volare’s classes and or using its facilities, (b) does not have a physical or mental condition that would put her/him in any physical or medical danger, and (c) has not been instructed by a physician to not participate in physical exercise. Member acknowledges that if Member has any chronic disabilities or conditions, Member is at risk in participating in Volare’s classes and using its facilities, and should not be participating in any classes or using Volare’s facilities.
